These Terms and Conditions govern your use of the Promontorio website and, where you make a reservation with us, your stay at our estate in Playa Flamingo, Guanacaste, Costa Rica. Please read them carefully. By using this website or making a reservation, you agree to be bound by them.
About this website
The descriptions, photography, rates and availability shown on this site are provided for general information. Photographs and illustrations are indicative of the property and its surroundings, and furnishings, planting and finishes may change over time. Nothing on this website constitutes a binding offer; a reservation exists only once we have confirmed it in writing.
Enquiries and reservations
Submitting an enquiry through this website does not create a reservation and does not hold dates. We will respond with availability and a proposal for your stay. A reservation is confirmed only when we have issued a written confirmation and received the deposit described in it.
The person making the reservation must be at least eighteen years old, must be a member of the party staying, and accepts these terms on behalf of every guest in that party. That person is responsible for ensuring all guests are aware of and observe them.
Rates, deposits and payment
Rates are quoted per stay and confirmed at the time of booking. Unless your confirmation states otherwise, rates are exclusive of applicable taxes, service charges, transfers, provisioning and any additional experiences arranged on your behalf.
A deposit is payable to confirm a reservation, with the balance due before arrival. The amount of the deposit, the due date for the balance, the accepted methods of payment and any security deposit or damage authorisation will be set out in your written confirmation, and those terms form part of the agreement between us. Rates quoted for a stay that is not yet confirmed may change.
Cancellation and changes
The cancellation terms applying to your reservation — including the deadlines by which a cancellation must be received and the amounts refundable at each stage — are set out in your written confirmation. Because the estate is booked exclusively, cancellations close to arrival are difficult for us to re-let, and later cancellations therefore carry higher charges.
Requests to change dates, extend a stay or alter the size of the party are subject to availability and may affect the rate. We will always try to accommodate them. Cancellation and amendment requests should be sent to us in writing and take effect on the day we receive them.
We strongly recommend that all guests arrange comprehensive travel insurance covering cancellation, curtailment, medical expenses and personal belongings.
Arrival, departure and occupancy
Arrival and departure times are stated in your confirmation. The number of guests staying must not exceed the maximum occupancy confirmed for your reservation, and only the guests named may stay at the property. Visitors, events and gatherings involving anyone outside the confirmed party require our prior written agreement.
Conduct and care of the property
Promontorio is a private residence in a quiet coastal setting. Guests are asked to treat the property, its contents, its staff and its neighbours with respect, to observe reasonable quiet hours, and to follow any house guidance provided on arrival.
Smoking is not permitted indoors. Pets are permitted only where agreed in writing in advance. We reserve the right to ask any guest whose behaviour endangers others, damages the property or causes serious nuisance to leave, without refund.
Use of the estate and assumption of risk
The estate includes a swimming pool, terraces, steps and paths on sloping coastal terrain, open outdoor areas, and direct access to the natural environment. It is not a supervised or lifeguarded facility.
Guests use these facilities at their own risk and are responsible for their own safety and for the supervision of any children and vulnerable adults in their party at all times, particularly in and around the pool and the ocean. Costa Rica is a tropical environment: wildlife, insects, sudden weather, strong currents and uneven ground are ordinary features of it, and guests accept those conditions as part of staying here.
Damage and liability of guests
Guests are responsible for any loss or damage caused to the property or its contents during their stay, beyond fair wear and tear. We may charge the cost of repair or replacement to the person who made the reservation, including against any security deposit held. Please report accidental damage promptly — it is almost always easier to resolve when we know about it.
We are not responsible for the loss of or damage to guests’ personal belongings, vehicles or valuables during a stay.
Third-party services
Where we arrange transfers, excursions, chefs, wellness practitioners or other services with independent local providers, we do so as a convenience to guests. Those services are supplied by the provider under its own terms, and we are not liable for their acts or omissions.
Events beyond our control
We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including severe weather, storms, earthquake, flood, fire, epidemic, government restrictions, civil unrest, strikes, or the failure of utilities or transport networks. Where such an event prevents a stay from proceeding, we will discuss the options reasonably available, which may include rescheduling or a refund of amounts not already committed on your behalf.
Intellectual property
All content on this website — including photography, film, text, design, the Promontorio name and any marks and logos — belongs to us or our licensors and is protected by copyright and other rights. You may view and print pages for your own personal, non-commercial use. You may not otherwise copy, reproduce, republish, distribute or exploit any part of this site without our prior written permission.
Acceptable use of this website
You agree not to use this website unlawfully; to submit false or misleading enquiries; to attempt to gain unauthorised access to it or to any server or database connected to it; to introduce malicious code; or to use automated means to scrape, overload or interfere with its normal operation.
Disclaimers and limitation of liability
This website is provided on an “as is” and “as available” basis. While we take care to keep it accurate and current, we make no warranty that it will be uninterrupted, error-free or free of harmful components, or that descriptions, rates and availability are complete and up to date at all times.
To the fullest extent permitted by law, we exclude liability for indirect or consequential loss, and for loss of profit, opportunity or enjoyment, arising from the use of this website. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.
Indemnity
You agree to indemnify us against reasonable claims, losses and costs arising from your breach of these terms, or from the acts or omissions of any member of your party during a stay.
Complaints
If something is not right during your stay, please tell us at once so that we have the opportunity to put it right while you are still with us. Concerns raised only after departure are much harder for us to resolve.
Governing law
These terms, and any dispute arising out of them or out of a stay at Promontorio, are governed by the laws of the Republic of Costa Rica, and the courts of Costa Rica have jurisdiction. If any provision of these terms is found to be unenforceable, the remaining provisions continue in force.
Changes to these terms
We may revise these terms from time to time. The version published here at the moment you make a reservation is the version that applies to it. The date at the top of this page shows when they were last revised.
